Crying is an emotional tool that can be abused to make the jury stupid in ways you want them to be. The same can be said of showing gruesome pictures of the crime. If the defense can't cry without a non-strategic reason, the prosecutor can't show bloody pictures without a non-strategic reason.

And what happens if the defense attorney cries anyway? Are they really going to sanction him or declare a mis-trial? Of course not.

If the defense attorney really is crying on cue, I consider that to be perfectly professional. His professional duty is to defend his client.

The underlying problem is that decisions that can end a person's life are made on the basis of emotional urges.
